Last I heard, MADD has lobbied hard enough that the legal limit isn't necessarily a mark of impairment anymore.
And there's where folks who are "all about the science" in all things all the way down to air-frying a chicken suddenly become faith-based true believers in what at best could be called pseudoscience and in some cases voodoo when it comes to this particular subject.

Part of what I was getting at. I'm actually not a dick, and have never got a DWI.
Just assigning a single BAC number to the entire population regardless of age, size, body type, tolerance, or anything else has no basis in medical or other fields.

It's not pseudoscience to establish a hard top-end limit for BAC, but still be able to show impairment enough for legal intervention at lower BACs.
That's just policy that you happen to disagree with.
Gonna have to show real world examples instead of just the academics of it.
There's people who are out of it at .06 and people who can function in a safe manner at twice that.
And that's still ignoring instances where somebody drank some beer but is obeying every traffic law and maneuver but gets crashed into by some fool who's so preoccupied yelling at their boy/girlfriend they're oblivious to their surroundings.
Guess who gets fucked in that scenario....
Perhaps we should just focus on dangerous drivers instead of trying to codify every last little thing that might make them dangerous...or not.

The "real world example" is that once you blow a .08 or higher, you're donezo whether you've got the "tolerance" or not.
The cop pulls you and you blow a .06, while simultaneously not passing a field sobriety test, you're done then, too. Hell, if you're so uncoordinated that you can't do it stone sober, then I don't want your stupid ass behind the wheel at all.
It's not hypocrisy or pseudoscience or anything other than a policy decision that .08 is the upper limit.
There's countless examples of people who won't pass a so-called "field sobriety test" while stone cold sober. Yet according to this sobriety test they are not sober?
Face it, there is none of this that passes any scientific muster, no so-called "forensic science" does. The only thing that does is DNA, which came from the medical field.
So, seeing as you support claiming a .08 level fits everyone.......a single person who can function at .081 defeats your argument.
It's as much stupid as BMI, or military or athletics height/weight standard charts, or how petite girls with C-cups "seem" more busty than tall girls with D's.

I'm not going to get behind graduated licensing where they determine your exact alcohol tolerance. Set a reasonable ceiling (.08 is fine), then pull the idiots off the road who can't manage even at lower BACs with field sobriety tests administered as needed when somebody's acting the fool on the road and get pulled by the 5-0.
