No mention has been made of threatening gestures. Someone carrying a large rock down the sidewalk does not constitute a threat to you.

This is far from "common sense". At no point did either of you specify that the law only applies when someone is being threatened with these implements.
 
For Christ sake, you think the police in the UK or Australia arrest workmen for carrying screwdrivers? The law is designed to catch people carrying such items without legitimate reason. Generally it might be a gang member carrying a screwdriver or someone carring a jemmy at night without reason. No response to the second part of my post? You see a man swinging a hammer as a threat? He might just be taking practice swings on his way to work, but I'd still consider him a threat.


edit - there's no point in continuing this debate. You live in a country that, for the most part, considers it acceptable to carry guns. I don't. If guns aren't considered offensive then I accept screwdrivers can't possibly be, but then I'd have to call machetes and spears OK too.

Why does one have to be a "workman" to carry a screwdriver? If I choose to walk around with a screwdriver just for the fucking hell of it I can. I don't need to prove a legitimate reason to anyone.

Things I have carried in my pockets for long periods of time that can be construed as weapons:

pens
pencils
screwdrivers
hammer
Exacto Knives

They all were for work purposes (having them) but I had them in locations that weren't related to work (getting lunch, travelling to locations, etc.)

Funny enough, yes. In some states and countries, if you do not disclose your HIV status, you are committing voluntary manslaughter or more serious.
 
The same could be said about swords, spears and clubs with nails in. 'I simply want to carry them' wouldn't go down all that well with the cops I suspect.

no it's simply counter to the idea that one should be presumed innocent until proven guilty. one should not have to prove legitimate reason for merely carrying a tool.
 
Yeah, it's got nothing to do with our country being better than another country. If someone proposed that law here I'd be the first to say how dumb it was. Why not just leave the laws that say you shouldn't hurt anyone in place and leave the weapons out of it? A hammer cannot hurt anyone on it's own but I could kill someone with a piece of string if I wanted to.
