The way Red Flag bills work for States that have them is the Miami FBI could have flagged her that would have kept her from being able to purchase anything in CO to include ammo.

Somebody in FL would've had to report her as being unstable first to get on that list.

You saying the FBI would be the ones reporting her? Then a local judge decide if she's nuts?

The FBI taking it upon themselves to flag anyone who posts crazy shit on the internet means we're all screwed.

Unless that judge is also a psychiatrist they're not qualified to make that sort of judgement either.

Even if the judge is a shrink, they still need to spend time with an individual in order to make that decision.

Well, it's not a judge putting people on a no fly list. So is that a precedent? Is it the same thing - it's just a potential threat list you can get yourself removed from provided you are not a threat?

Not for an immediate hold. If there's evidence or anything that shows possibility then freeze it all. That is why it's a phase approach for Red Flag rules. I think the initial is a 7 day hold then another hearing.

Not misrepresenting that I'm aware of though I might well be ignorant of some of the details of how this process is supposed to work.

Also there are varying degrees which can allow for a freeze where they can't purchase something, temp seizure of weapons, and a full out you're not getting them back.
 
And the defense for the Sheriffs who aren't wanting to enforce it have been 3 things. 1st the usual "2nd Amendement". 2nd they think it's a way for criminals to target someone. Have their firearms removed. Then attack them after. 3rd they say it's too dangerous to seize weapons from someone.

At what point do mental health professionals get involved and who pays for that?

Is it still the State having to prove its case against the accused or does it morph into the accused having to hire professionals and lawyers and experts and spend time to have a reasonable shot at proving their own competence?

Most initial holds from hospital ER rooms are 72 hours, the "5150". It would be a major pita for the cops to go to the home of each person in that position to make sure they have no weapons. They'd have to do that for everyone if they are doing it for anyone.

As a little kid fuck yeah I was. Especially living in Europe at the time. As a got old no it became like a fire drill. The active shooter ones are pretty scary especially to someone under the age of 10. It was hard enough to only partially explain to microflop a little bit ago why her school was really closed. Their minds can't comprehend certain things like the why. Which is why the school tells them things like there's a snake outside vs there some lady with a gun.

No fly list isnt covered in the constitution.
Kind of a dumb way of looking at it, but it ultimately is the key to US law.

These rules aren't to inspect. They are there to prevent future purchases and brought when someone associated with that person knows they have them and there is intent for them to utilize them against someone or themselves. It's not a or you didn't pass this test so we need to go see what you have and take your shoe laces.
