Ontopic Stand Your Ground prosecution screws the pooch again.

dude I never said he should have to flee because he's in public. In any situation, if there's a way out of it without death, that way should be taken first. Guns are for last resort only.

SYG protects his right to not flee. It places the act in his hands and gives him the ability to judge what is safe and what isnt.
If you remove SYG then you remove his right to stay there and his right to judge the situation. In that case, had he stood there and shot he would have gone to jail.

Unfortunately the link posted is biased to his side. I can understand where force should be used to project yourself against death or extreme harm but a standard fight with multiple people around doesn't fall into that category to me. I can understand if it was just them two and knowone around but in a outside bar fight using a gun is excessive and the guy made a bad choice to pull his weapon and now he's paying for it.

I don't care about his rights, and yes my rights too, in that situation. I care about people trying to get out of the situation without anyone being killed, if possible. When, and only when, it is not possible should you be allowed to end someone's life.

If someone drives an otherwise rational and reasonable person to the point of pulling a firearm, then they have forfeited the right to walk away unharmed.

We both agree on that. We just differ on what can be justified in that concept.

Hey someone just broke into my house, we should flee!

Hey someone broke into my house! I could shoot him or duck out this door here and be safe. Nah fuck that I'll just shoot him! Oh shit he's got a gun also! Damn he also shot me! BUGGER!!

Of course you should. You just bloody killed someone. You should be arrested, investigated, and then either freed or tried.

you are aware that in the US, you can rot in jail for 6 months before a trial, right?

I'm going to disagree. Just like w/Zimmerman, if the cops don't see that something illegal was done, there's no need for an arrest.

I don't think you should constantly get arrested & then be interrogated later to see if you committed a crime.

Y'all bein trolled

cource we are. its amazing how good 123 is at it. Or how dumb people are that they dont notice it....

he's brought up like 8 topics in the past 2 days that are purposely very very trolley

Stand Your Ground laws exist because we recognize how ridiculous it is to be expected to flee from every situation. Sometimes fleeing is more burdensome and dangerous than protecting one's self with force, which everyone has the nature-given right to do.

We're all proud americans. Pledge alegiance to the flag. A nation of laws. The land of opportunity.

but in this instance, the whole 'one law for everyone' fails this guy.

His Judge stated “Frankly, I think the 25-year mandatory is overly harsh based on the facts of this case, but that’s what the law requires I do and I intend to follow the law.”

So here's where American's are fucked. The only out this guy has is that someone else gives enough a shit about it to actually get the law changed or add another law implemented for this guys situation. this is why ''voting' is important, why paying attention to the world around you is important, why contributing to the world around you is important.

with liberty and justice for all. . .

really?

Goes the opposite as well, mandatory sentences are made to prevent stuff like that child rapist who only got 30 days in Montana because the judge was an idiot.

Needs to be standard sentences than have a court that can reduce those based on their discretion off the severity of the crime.

Mandatory sentencing actually isn't to regulate the judiciary.
