Supreme Court extends federal benefits to married gay couples

Are you saying the Federal government requires states to share that info? I doubt that's the case, but welcome the knowledge.

edit: Now that I think about that, even the Feds do require that, I think that should be unconstitutional as well. There is nothing in the Constitution about drivers licenses. The states can cooperate on their own without parental intervention. The CCW permit is a classic example of it. Or traffic tickets following you to your home state.

I'm saying it's specifically banned by DOMA in this case. But as for on a regular basis, it's kind of a gray area. There's a clause in the Constitution about this because the writers could foresee problems associated with each state having its own laws. It's called the Full Faith and Credit Clause. It talks about how states can and sometimes must recognize the laws of other states. There's a lot of debate about how this relates to marriage and divorce and a lot of other issues. For example, can a father or mother move to another state to avoid paying child support required? If I am a gay man and I adopt a child in Maryland and I then move to Virginia, is that not my child anymore?

Thank you augusttremulous for the great recap!

Also the concept of marriage (straight or gay) has ALWAYS been a state thing. Just recently has the feds put some stock into it, offering benefits and joint taxes, etc. But it has always been a state run thing. States can choose if they recognize marriage licenses from out-of-state proceedings, from same-sex couples, from international marriage licenses, etc. That is each state's prerogative how and what they classify a valid marriage is and how and what they do with that. This ruling just means that those benefits the feds have added because of a marriage contract are equal from any state, no matter the type or marriage license gathered. It's a great step forward, especially with regard to binational unions and military retirement and health benefits (which 100% directly impacts friends of mine). This also gives ammunition to law suits in the future challenging the individual state statutes banning same-sex marriage recognition; if other states can issue the license, and the feds can recognize it, why can't my home where I pay taxes recognize it, too?

And this is exactly how it should be.

This song came up on my playlist this morning, and I think it 100% perfectly summarizes my thoughts on the whole issue.

I'm not so certain he's against it. He's got a gay family member or something.

Accepting the person doesn't mean accepting the lifestyle in terms of what should happen in a governmental policy.

Now I could totally be wrong and he could be perfectly fine with it, but I vaguely recall him stating he was against it.

Kevlar? She wasn't against it (at least not vocally) She was a die hard Republican, but I don't recall every hearing her say anything against it.

She was going to vote for Prop 8 until I called her and explained the implications and how it impacted (or not as the case would be) her. She changed her vote before she went to the voting booth. I just wanted to give her more data because she didn't know exactly what Prop 8 meant to her or what even a No or Yes vote meant. She still didn't care for same-sex marriage, but being a true conservative, it didn't impact her life and liberty but it did impact others, she voted against Prop 8 and FOR gay marriage, the wise choice.

Sadly, people vote without reading and toe the party line. That's why this country is fucked.

doesn't stop liberals, or libertarians, or atheists, or jews, or....

while the picture is painted as just a republican issue, it's not.

True. But we're talking about the views in a political sense. I'm pretty sure atheists don't care about the Bible when it comes to whether or not gays marry or not.
