GAY Teacher investigated for anti-gay facebook posts

Private companies are different than a public school. Presumably teachers are in the civil service? There is usually a clear legal mandate for how government employees are hired/fired. Private companies can terminate your employment if they don't like you *shrug*

That's fucking horrible.

Why? A private company is owned by a private citizen. If that citizen doesn't want you working for them, why should they be forced to? Elaborate on your answer a bit.

Yeah. It's not awesome when someone has a personal vendetta against you but trying to legislate ethics is idiotic.

Because no one employment should be terminated due to someone whim. It should only happen under strict guidlines. Yet another thing I fucking hate about this shit hole of a country. Fuck I want to leave so fucking bad.

That's up there with the most retarded shit I've ever heard. That's what the entire legal system is based on. Fuck.

 So you support attempts to outlaw abortion/other neo-christian laws? BECAUSE THAT IS LEGISLATING ETHICS. It just happens to not be your own personal ones. Essentially you are bitching because the world doesn't subscribe to your own personal set of values. Now if only you could PROVE that your ideas about ethics are any more valid than any other random person/groups.

ETA: The ability of private corporations to have discretion in their own operation is what makes them succeed or fail. If they are completely driven by whim of their owner to an extent that it ruins their operation by costing them talented employees they will fail.

Good example to think about in the news recently is Apple. Steve Jobs, firing people on whim, all the time. Apparently that sort of disgusting behavior wasn't enough to keep people from buying Apple's products though and it didn't effect their bottom line in terms of R&D.

I disagree very strongly. If it's a publicly owned company then sure, but if it's John's Meat Packing Plant then John can and should get the final say about who he pays his own money to. If you painted houses and I went to work for you and then had an affair with your wife, should you be able to fire me then? What would the guidelines look like? Which hairs would we split?

It's true, it's happening more and more, and not just on the gay rights issue. Companies are firing employees over opinions they've posted on their personal facebook page too. It's a fuzzy line I think and I'm not sure where we need to draw it.

And Dave, your opinion would probably be a valuable addition to this conversation. Why not give it?

This is why my FB is pretty much locked down, and I don't have people I work with on there.

Agreed. Employment isn't a right. Making it difficult to fire a douchebag who is actually affecting the workplace and profits because of strict guildelines in the private sector is unacceptable.

This varies from state to state. Here, employers can face huge lawsuits for wrongful termination. Sometimes it's hard to prove. Sometimes it isn't. My country club went through this with the termination of their general manager. It cost us roughly seven million dollars. And we deserved it.

The fundamental difference I'm seeing here is that you care more about the individual property owner than the good of the nation. Being able to fire someone because you don't like them is extremely bad for a country to prosper.

America should take a look at the Australian Fair Work Act of 2009.

Follow along. No body said anything about not being able to fire someone who is actively trying to affect the workplace. In that situation, termination of employment is fine. We are talking about someone firing a subordinate simply because they don't like them.

Also, nobody said Employment is or should a right.

Hi. Have you been to America? No way the law would be passed if it didn't encompass everyone, not just situations involving douchebags.

THE LEGAL SYSTEM IS A CODE OF ETHICS. Fuck me.

I wouldn't expect a country club to have HR, but larger companies I've worked for have vague employment agreements that essentially make fabricating 'cause' a non-issue when they want to get rid of someone. I expect they have statistics or something of the likelihood of someone coming after them for wrongful termination, people who can't leverage the costs of a lawyer are only going to come back and bite them if the termination was especially heinous.

Out of curiosity, how many of you guys are bosses, and how many are employees?
Contractor/Employee.

ETA: When I was a teenager I got 'laid-off' once because someone didn't like me. They didn't even bother to tell me I wasn't working there anymore, they just stopped giving me paychecks.
