another concept that is germane to this example would be perjury - if freedom of speech meant freedom from consequence for said speech, perjury couldn't exist/be a crime.

it would be a violation of HIPAA and as such there would be legal consequences regardless of damages/defamation/slander.

my point wasn't that it would be the exact same legal scenario, it was an example of another situation where someone could face legal consequences for their speech

I just think the "clear and present danger" doctrine is more illustrative of the concept.

im just saying him going out and lying is not hurting them. their kid is dead and him lying can't bring him back. is it an asshole move to knowingly say that it was fake and the kids are still alive? Yes. I just don't see how it is criminal though. it is just words

I was aiming for something that was a similar degree of (non)threat because I was trying to avoid a response that was like "well yeah OBVIOUSLY in THAT case it's different, but," and I wanted it to be something semi-relatable - I don't know if @King Wickie Pelt Snatcher has ever actually had an STI and it's none of my business either way, but I wanted to pick something that is within the realm of possibility (for anyone who is sexually active, not him in particular) and which also carries a stigma.


violating HIPAA isn't typically going to be itself overtly/immediately threatening or dangerous, but it could still have serious and devastating consequences for the person whose privacy was violated.

I think most people who yell freedom of speech are just idiots, right up there with I want to talk to your supervisor and you cant arrest me.
 
What the fuck is going on with CPAC?
Note: this is not the start of a porn. This is MTG praying with an actor portraying a jailed Jan 6th rioter. All he did for all of CPAC was cry.

The irony of her being there to help him pray, when she should be in jail is... its too much, it hurts.
