I'm feeling too lazy to read everything in this thread right at the moment, but there is a VERY simple solution to the insurance problem.

Insurance companies can simply put a clause in the contract to not cover head injuries if the rider wasn't wearing a helmet. That way, logically (AHAHAHAHAHAHAAHA), it wouldn't affect everyone else's rates.
