So I've thought about doing something VERY simple, like just a phrase or something on a shirt.

Can you do that?

Like if I did a shirt that said "Useless Forums is Useless" no one else could make one like that right? if it was trademarked?

How do you go about doing that?
What are the costs?

Enemy's foray into making her own clothing had me thinking about it, too.

Interstate commerce is because if you paid attention in civics class youd know that the federal government has enumerated powers and can only regulate commerce between the states and with foreign nations.

Many trademarks come out of common law though. You dont have to register them, just use it. It would have to be original and non confusing of course. >.>

Call an IP (intellectual property) attorney at a reputable firm in Tampa or Miami. Ask them for a quick 10 to 15 minute free consultation and pose some basic questions. Happens all the time, and most lawyers don't have a problem explaining the fundamentals pro bono.

I couldn't possibly count the number of times I've told people this before, but never seek legal advice on the internet. As a rule of thumb. Trust me.
