Short of thousands of people seeing the person doing it right infront of them, I don't think you can. I guess that's why they say 'reasonable doubt'.

I'd be all for the death penalty if it actually served as a deterrent, and if it were the cheaper option, and if each sentence were carried out on pay per view, and if we were 100% certain the person in question was the guilty party, and if the person carrying out the sentence was god. Unfortunately, none of this applies, so I think it's a horrible idea.

there are several cases where people have been set free when the truth was discovered. sometimes many years later.
