So a friend called me today who manages say, an autoparts delivery service. She had heard through the grapevine that one of the employees was sleeping one of the old vans out in the parking lot - DURING WORK HOURS.

She went outside, verified said story, and called HR.

She was told that the employee can only be written up, not FIRED. Her theory is that he was up all night, came to work so he wouldn't be in trouble for absenteeism (possibly took a xanax or something to counteract last evenings events) and decided to sleep in the truck.

The only thing you can do at this point because everything is hearsay is discuss the implications of him sleeping in the van, make sure it is listed as "what not to do on the job" and not bring up any rumors of possible drug use. WTF?

One more thing you can be sued for as it can be construed as "discrimination" a HIPPA violation and or 100 other resaons to get your ass sued.
 
We've got a guy living out of one of our storage units. Unfortunately, the cops can't escort him off the premisses because it's private propert or some other such nonsense. They can, however, wait until he takes his crap-ass, expired tag vehicle off the property and get him. What makes it worse is that he is an employee for the motorcycle shop. :mad:

Assuming the person doesn't have a medical condition, how the fuck CANT you fire them in a 'right to work' state?
 
Georgia is a right to work state so you can be fired at anytime for anything and that's that.

We fired a guy for sleeping while at work. Dude had a pillow and blanket and made himself up a little place to sleep in the basement of a building. It's hard not to say it's premeditated when you have a pillow and blanket. Fucker left hime that morning saying "I'm going to go sleep at work and be comfortable."
 
He can be fired for sleeping, only after he is warned that it is not part of his job description. LOL

The real problem here is the potential drug use on the job that can't be discussed outright (it is considered accusatory and if challenged can lead to a lawsuit) and you can't ask certain questions about medical conditions that could lead to the sleeping nor can you ask him to take a drug test unless you have random tests already in place (and I mean TRULY random) and something in writing. My friend is very frusterated!

Fuck - I have no idea!!!! People are so scared of being sued for discrimination or slandere or whatever that these rules have been put in place to allow your employees to walk all over you. It's fucked up.
 
Candy just carry a roach with you. Take one from any ashtray in your house. And stop to talk to the guy and slip the roach out of your pocket and flick it by his foot. All of the sudden ask"What is that?! Is that Drugs?! Were you doing drugs at work!?"

He'll be gone.
 
One day I came to work and thought my boss wasnt here. Half the day goes by and I start hearing some weird mubbling in the back room. I go back there and hes sleeping on the floor with a bag of shredded paper as his pillow, pictures are around here somewhere, lol
 
What complete and shitty policy, which I'm sure is needed because of these shitty laws saying you can sue for pretty much anything. Why doesn't anyone ever enforce the law against being a dumbass with no common sense?
