I agree that it's still assault, no matter what, but it makes it more difficult to prove if she won't testify, which weakens the legal case.

That would be better than nothing, but I would think it would still make the case harder to prove if she wasn't testifying willingly. She probably wouldn't give them the whole story, and would hide as much evidence as she could get away with.

It always make the state's case look weak which is why it rarely done.
