Section 102 -
Authorizes the Secretary to suspend the registration of a food facility if the food manufactured, processed, packed, or held by a facility has a reasonable probability of causing serious adverse health consequences or death to humans or animals.
(1) The term “facility” includes any factory, warehouse, or establishment (including a factory, warehouse, or establishment of an importer) that manufactures, processes, packs, or holds food. Such term does not include farms; restaurants; other retail food establishments; nonprofit food establishments in which food is prepared for or served directly to the consumer; or fishing vessels (except such vessels engaged in processing as defined in section 123.3(k) of title 21, Code of Federal Regulations).

If Sebelius believes the way you grow your backyard garden has a reasonable probability of causing serious adverse health consequences (read: in the long run we feel our way is better than your way) she can shut down your backyard garden.

No. I don't think she's showing up here with her list of 'how to's.' It's the fact that the proposed law allows her to is what is disturbing.

i.e. Instead of waiting until a Christian Scientist is denying a sick kid the benefit of doctors care, the gov't is shutting down the ability for a citizen to do it their own way until there's a problem.

What's next, mandatory vitamins?

It's just another potential intrusion that does not need to be there.

The problem further exacerbates itself when you get a billion dollar produce grower that wants to control the marketplace. "we can prove that the average backyard green bean grower product has more of a reasonable probability of causing serious adverse health consequences because our product has far superior control mechanisms in place."

If anyone thinks the government give 2 shits about the safety/health of the people then you are a fucking moron. This is nothing more than big corporations (read: Monsanto) pushing the government around in order to bolster their monopoly.

The problem is, it gives the government an excuse to arrest ton of people when they can't get them for what they really want to get them for.
