According to this article (which I tried to link to this post) companies are automaticly not considering applicants for jobs if they aren't currently employed. I guess the reasoning is that these people aren't working because so something they did. Like for some reason it's my fault the powers-that-be decided to invest most of their money in ING. And of course when the market crashed they downsized the workers based on seniority, not performance. Well now I know why I get "thanks, but no thanks" responces when I submit my resume.

i've heard this before. a friend who was previously in charge of hiring for some company said it's always better to take whatever crap job you can get if you get laid off or fired, so that when you're applying for a better job they don't turn you down for being unemployed.

A good friend of mine was a butcher with Kroger grocery stores. He's been out of work for almost 9 months with various health problems and just started dialysis. His doctors have said flat out that if he tried to return to his old job that it would most likely kill him within a week or two. Kroger keeps his name on their payroll so they don't have to pay him unemployment. They say repeatedly he's free to quit but otherwise they're not releasing him. How can they do that?

Has HR said this? He should be able to go to HR. If not, then ACLU

The store manager has flat out said that to him. My friend was a really hard worker and originally got sick from working in the cold meat department then they'd bounce him to a hot area to work if short somewhere else. He got a super super bad cold that turned into pneumonia quickly. During the treatment for that mistakes were made by the hospital and his kidneys were badly damaged and now his overall health is really bad. I just took him back to hospital when he's only been out for less than two weeks. He kept going back to work whenever he could until his doctors told him to stop it.

The store manager isn't HR. He needs to go higher up.

I've been talking with him. He really has been in seriously bad shape. I'm going to visit him tomorrow and will talk with him more about it. He has no insurance because they kept his hours 1 hour below full time to avoid giving him full benefits.

He's still trying to get on disability. The dialysis place says typically once you start treatment you go on disability but they keep giving him trouble saying his condition is treatable. Um, treatable with dialysis 3 times a week, a ton of meds everyday, is going to be sent home with an oxygen tank, and most of the time is so weak he can barely get around with a walker.

When I took him in the other day his blood pressure was super high so they order him some meds to lower it but forgot to give them to him. They ended up giving them to him right before dialysis and during the process he his vitals crashed and he almost died. His doctor was super pissed and tore into his nurse in front of him asking if she was actually trying to kill him. He called me earlier asking me to help him escape before they kill him. I said no.

Nope. His work was notified by his kidney doctor and heart doctor that he was unfit for work and a major health risk if he tried.
well then he's probably not going to get unemployment. even if they fire him for not showing up for work, i don't think you can draw unemployment for that. and they're not going to fire him for something else. he needs to go on disability.

how the fuck did pneumonia turn into fucked kidneys, anyway? he screw with his medication or something?

If they fire him, he can sue them for forcing him to work in an unsafe environment and negatively impacting his health (and then firing him when he became of no use to the company).

this is only true if the work environment caused the problem. if all this stems from a mistreated cold i'm not sure whether that would hold.

He got so sick that he went in for treatment. They ignored his diabetes and the wrong meds started a condition that may not have been eveident until he was an old man. He starts building up extra fluid in his chest around his heart and lungs. They drain gallons off of him. I've seen the jugs. yuck. Any way they use Lasiks to speed up the process and way way over did them and have caused his kidneys to start shutting down.

Something very similar to this.

The hospital made him sign paperwork saying he couldn't sue or they would discharge him after all the damage was done. If he left then he would have died for sure. A day or so after he signed the paperwork that time he went into a comas for over a week.

Well, if he had a good lawyer they could argue that the working conditions caused his illness to worsen, and today still contribute to making it worse.

That would be, as Jonny suggested, workers comp, those cases can drag on forever though (The insurance company will bet that he is going to die soon and won't settle) but he should be able to get a weekly check at least.

Some, even good, attorneys will fight those cases and take a reasonable percentage from the checks as payment in the hopes that they can eventually get a big settlement.

yeah, there's big money written all over that and from 2 "donors"

in the united states of the overly litigious

i was actually thinking of social security disability, but workers comp is also a good avenue. frankly, i don't know much about this at all.
